| 1. Right of Cancellation
In accordance with the provisions of the Consumer Protection (Conclusion of a Contract at a Distance) Regulations 2000, you have the right to withdraw from this transaction.
You shall have a period of 7 days after the date on which you have received the Goods to withdraw from the Contract and to return the Goods to us. Subject to the provisions of Section 5 (below), you shall be responsible for payment of the direct costs in returning the Goods to us and we shall be entitled to deduct from any refund of the price for the Goods an amount equal to such delivery costs as are paid by us on your behalf.
The right to withdraw from the Contract does not affect any of your statutory rights.
In the event that we supply substituted Goods to you in accordance with the provisions of Section 5 , your right of withdrawal is as set out as above except that the cost of returning the Goods shall be borne by us.
Perishable items, including flowers, are not covered by this policy, as per the Distance Selling Regulations.
2. Delivery & Postage
Postage is £4.95 for UK Mainland, Ireland, Isle of Man and Channel Islands standard delivery to each address and includes any extras such as balloons or bouquets.
Express Delivery UK Mainland, Ireland, Isle of Man and Channel Islands - 48 hours @ £9.95
Please note that 48 hour delivery is only available
for orders placed before 12pm Monday to Friday.
24 hour delivery is not available for weekends
Free Hand delivery is available in the Porthcawl area
We cannot post to PO Boxes
We cannot guarantee delivery if the address provided to us is incomplete or incorrect.
Additional postage charges will be applied for redelivery.
We will email you with the anticipated date of arrival.
All deliveries, unless hand delivered, will be sent via recorded mail and will require a signature.
Please ensure that there will be someone available to receive the goods at the delivery address.
If goods are lost or damaged in transit please let us know promptly.

2.a Delivery to Hospitals, Schools, Hotels or Business Premises
Please be advised that The Basketcase is unable to deliver baskets and gifts personally to an individual recipient due to our delivery agent, Parcel Force being unable to offer this service. Deliveries made to hotels, schools and hospitals are usually restricted to the central delivery point: concierge or main reception or post room. The Basketcase’s part in delivery is considered concluded once a gift has been delivered and received by a member of staff at the central delivery point. Whilst The Basketcase Team will assist in locating a gift that is not received by the recipient within a hospital, hotel or business premises, we consider the limit of our guarantee and involvement concludes on proof of delivery to the central delivery point and not the recipient.
3. Orders
You will be given clear instructions to follow to navigate the Order Form.
We require that you provide us with your personal details, and accurate postcode, and also those of the intended recipient. We require all necessary payment details. Payment is accepted via all major credit and/or debit cards. By clicking on the 'check out' button on the Order Form, you are consenting to be bound by our terms and conditions contained in these Terms and Conditions.
Note that the submission of your Order Form is subject to our acceptance of this offer when we issue a written confirmation of acceptance by e-mail to the e-mail address with which you have addressed us. This message will re-confirm elements of the order(s) you have placed including confirmation of your card message. We will not consider ourselves bound by a contract with you until we have issued this confirmation.
We will confirm your order details and advise you that we are processing your purchase when we e-mail you.
Please note that orders must be paid for prior to despatch.
4. Pricing
Rarely do pricing discrepancies occur, but just to be sure we verify prices as part of our dispatch procedure.
If an item's correct price is lower than our the price stated, we will charge the lower amount and send you the item.
If a product's correct price is higher than the price stated, we will notify you of the correct price and offer you the option of accepting the correct price or receiving a full refund.
5. Disclaimer
All Basket Case prices are exclusive of delivery charges.
We reserve the right to substitute items of equal or greater value if a particular basket component is out of stock at time of purchase. If you decide not to accept the substitute goods, you will not have to pay to return them to us, providing they are in the original state and in the case of consumable items, unopened. Your statutory rights are not affected.
In the event that we are unable to supply the Basketcase Product or any substitute product to you at all, we shall notify you as soon as is reasonably possible and shall reimburse your payment in full and in any event no later than 30 days after the intended delivery date.
6. Alcohol
No persons under 18 years of age may place an order or receive Goods from The Basketcase if the Goods contain alcohol.
7. Returns & Refunds
Under the Distance Selling Regulations you have a right to cancel your order for any item purchased on this website, for a full refund. This does not apply to perishable goods (e.g. food and flowers.)
To cancel an order please contact us in writing, either via email, fax of post within seven days of delivery of your order.
Items returned must not be used and should be wrapped securely. We will refund the purchase price of the goods to you on receipt of the goods. The price of shipping will not be refunded.
If you cancel your order before it has been dispatched, a refund will be credited to your account. All refunds will be made within 7 days of the cancellation.
These terms and conditions do not affect your statutory rights.
If there is a problem with the basket or a component contained within the basket, please contact us within 7 days of receipt.
Damaged Goods must be returned to The Basketcase @ The Wild Bunch, 2 Lewis Buildings, Porthcawl, Bridgend CF36 5PE , suitably packaged. We will replace or refund the damaged items concerned, including shipping costs.
We will deal with the matter in accordance with your legal rights.

The Basketcase takes complaints very seriously and prompt attention will be given and in the strictest confidence. We will acknowledge your complaint within 72 hours and give you a timescale for resolving the complaint as well as keeping you aware of progress.

Our site uses an order and registration form so that you can request information, products, and services.
Contact information (email address, telephone number, address, etc.) from the order form are used to send your orders and information about our company to you.
Your contact information is also used to get in touch with you when necessary.
Financial information (credit card numbers, credit card expiration dates, billing address, etc.) that are collected are used to bill you for products and services.
You may, from time to time, receive information from us about new features, new services and special offers we think you'll find valuable.
